Thread: Any professional lawyers who are ABDL

    Default Any professional lawyers who are ABDL

    Mostly just curious. But it's a good idea to know if anyone out there might be able to defend one of us in case there are cases where we get in to legal trouble because of our fetish, through no fault of our own.

    E.g.:

    Some joker in CPS decides you are an unfit parent;

    Some DA decides your drawing of yourself as a baby and getting changed is kiddie porn;

    Internet bullying (civil matters, and assume we could 'catch' the bully).

    I post with full realization just like doctors, lawyers usually have specialties.

    The bigger issue is whether one of us is a lawyer in the correct jurisdiction who specializes in the type of practice necessary.

    Having a local lawyer who knows the judge and courtroom staff is much more important than one who personally understands your situation.

    This sounds like the most unrealistic occurrence imaginable. In any case, computer-generated images of minors are not illegal and what laws do exist on the matter are almost entirely unenforced. You can find quite a lot of it with Google. I used to have a friend who read hentai with incest porn in it while waiting for classes to start.

    I'm a lawyer. I'm barred in California, but I work for the federal government. I'm sorry to say that I have neither the specialty nor the interest to represent anyone here on Adisc, nor can I ethically provide legal advice on someone's individual case without undertaking representation.

    I am, however, more than happy to help direct someone to legal services that might be available to assist them, and I tend to enjoy speaking in general about the law as long as it doesn't range toward legal advice with individual problems (which, again, is unethical). Anyone can feel free to PM me if they ever want to talk. I'll usually get it within a day or so.

    Also, lawyers, like doctors, have special confidentiality rules. If you ever need legal advice, you should be candid with your lawyer and discuss your goals and priorities, including whether you want certain information to remain confidential.

    I shall also like to point out, in addition to what ArchieRoni has stated insofar as ethics... The ADISC Rules (Under "Legal" inside the spoiler, 5th bulleted down) Specifically states:

    Nothing on ADISC should be construed as any kind of professional advice, be it medical, legal, or of any other kind. We advise people to always consult a qualified professional in the event of legal, medical, or similarly serious issues.
    and to further offer additional interpretation: The "Qualified Professional" is probably to be sought outside of ADISC as well, perhaps Moo, or another Moderator will be so kind as to clarify further, or correct me...

    To my understanding, referrals and anecdotal-endorsements to resources would not be restricted...

    As to your concerns, HokieABDL... I can't see that you should have these concerns without Probable Cause... unless you're doing something to specifically call attention... it should otherwise be no more concerning to you or the law as that of having IC, and/or a leather, or some such fetish... which obviously should never involve a child... If you feel wrong about your drawings, then perhaps it is wrong. Otherwise, it may be protected, or non-liable material... but, again...context... and circumstances, and jurisdiction, and your jurisprudence is to be heavily weighed...

    With respect,
    -Marka

    There is a form of Japanese art called Manga Lollicon. It is illegal in the US though it is artistically created drawings and not photographs. I will not describe it here because they are disturbing to my cultural standards.

    Though the scenario I portrayed was far fetched, I concede. However, I would think that there are tunnel-visioned prosecutors out there who think we are somehow criminals.

    I'm aware. There's a really good Wikipedia page on the matter. You'll note that prosecutions are exceptionally rare and successful ones tend to occur when the accused also possesses actual child pornography.

    In any case, I'd like to reiterate my two main points. Even if there's a lawyer among us that doesn't do any good unless they're a trial lawyer specializing in first amendment issues and practice in your area, and that having a lawyer who knows the judge, courtroom staff, and prosecutor is infinitely more valuable than having someone who's also ABDL. Soliciting for legal services among our community for an actual prosecution of this nature is a very, very bad idea.
