I don't see it as any different than trying to haul AT&T into court for allowing a scammer to call me. They're a mass-communications provider, and can't reasonably be expected to moderate the use of their service.

I don't know how anyone gets any traction at all when trying to hold a forum responsible for the posts made by their users.
 
It may be daft but it's the law, and "kiddie porn" is one of those dog-whistle subjects that allows lawmakers to pull really stupid shit to "protect" the children and shut down rational debate.

I bet this won't decrease the amount of kiddie porn on tumblr (and I've seen a few regulars complain that kiddie porn and neo-nazi / white supremacist stuff has actually gone UP since the ban), it's just screwing over a big community of marginalised people and creatives.

Yep I know, anyone can sue anyone else for any reason at any time (unless your right to file has been temporarily barred due to repeated abuse and pissing off a judge, which does happen occasionally), but it all comes down to whether or not you can win. That's why I said "I don't know how anyone gets any traction". I'd expect if the suits were too meritless, they'd be getting tossed out of court often enough to not be enough a credible threat to cause companies to make pre-emptive changes to avoid being targeted by such litigation.
