In current ABDL news: Rearz is being sued.

So... In news that probably doesn't really suprise anyone; Rearz (and apperantly Little For Big) has been targeted by Aww So Cute in a lawsuit that alleges that Rearz called up the Chinese company making the diapers for ASC and bought them out from under them.
Considering that Rearz has the ASC diapers in their mystery box that only debuted after the holidays it looks like a case of offloading the evidence.

Geez, that's a pretty serious claim, and it seems like it's well founded. Pretty crummy thing to do on Rearz's part.

How is Little for Big involved though, are they a partner company to Rearz or something?
 
I wonder why the Chinese company sold their supply to Rearz when it was already earmarked for another company? I wonder if the Chinese company should be sued?
 
Sure, it's a lame thing for Rearz to do, but how are they breaking the law? It was the Chinese company who likely broke their contract with Aww So Cute.

god. pairing that up with the trademark story, i'm never getting one of their diapers again.
 
They basically are asking for damages from every reseller of ASC diapers. The biggest question will be if the other companies were authorized to resell and also use the images. Honestly, it looks like a grab from a business that is going bankrupt through actions of their own, like putting their price point versus product quality too high. Kind of odd seeing so many companies making the same 'illegal deal' with a chinese manufacturer.
 
I once bought a package of ASC diapers. Sorry to say, but they were a little expensive, and I didn't think the quality was as good as Bambino's offerings. This lawsuit isn't going to help this community much, and it may also have a negative impact on those with medical needs.
 
The negative I see right away is the already limited offerings in Canada (Decent shipping costs, etc) just got smaller. I picked up one of their mixed cases just before Christmas and the order went smoothly, but oddly a couple of days after my card had been charged and processed and my order was in transit a second charge for the order went though. I immediately contacted them on it and the owner passed blame on the bank. Not surprisingly, the charge vanished within hours of me asking them about it. I have asked them questions, both through twitter and their own sites contact us section regarding various product questions before that and never got an answer (Seems they only reply to things that kiss up to them.)

- Did their business tactics need work? Sure. The latest info registers that 100%.
- Was their customer service and how they see the the community lacking? Ive seen negative and positive; mostly negative.
- Were their products outstanding? They were the first ABDL brand product I was able to try and while it was great to finally see what all the hub-bub was about; I wasnt blown away.

Sadly though, up North of the border most places selling product are medical based and while some acknowledge the ABDL market; its not their main focus and any stock carried is usually at a higher price-point to cover the costs on them for carrying the stock.

Ohhh... You aren't familiar with the way that Chinese companies do business...?

Copyright infringement is a fairly new and foreign idea in China. In the West, capitalism is understood and accepted as a way of life. In China, socialist values where (traditionally/ideologically, at least) private ownership of the means of production (including intellectual property) is banned, and the means of production is owned and controlled by the state (in theory), the idea of copyright or trademarks is meaningless.

Factories are only allowed to operate with the approval and oversight of the Communist Party, who also run the legal and judicial system. If you wanted to sue a Chinese entity, you would have to do so under Chinese law, with the Communist Party overseeing the case and being strongly biased in favour of Chinese enterprise.

Most Chinese factories will happily "borrow" (or leak) intellectual property and sell knock-offs... or break a contract if they found someone willing to pay more for a diaper shipment. It's just seen as good business; a minor indiscretion.

Like, BMW tried and failed in the Chinese courts.
And not to beat around the bush: these diaper 'brands' are pretty much off the shelf concepts with all the r&d and tooling having been done long ago by others. The part of the brand owners is limited to whether to have stripes or dots as a pattern on the foil. I fail to see anything new or unique in them and any graphics are easily done by an 8yo.

If these middle men get themselves all worked up over such trivialities, they'll just be digging a hole for themselves.

And course, let's not forget the irony within such debacles that they only exist because of the free use of ideas (containerization, internal combustion, the wheel, etc).
 
I'm not sure this has legs. I mean Rearz never represented them as their diapers and they technically never even sold them on account that they were selling a subscription box service, not the product itself. As far as I'm aware, they never represented the product on their website anywhere by name or image. It'd be hard for Aww So Cute to prove that this harmed Aww So Cute's business as no one knew what came in the mystery box and even if you bought it a second time, there was no guarantee that you would receive the same product twice.

Now, I'm not saying that it was right of Rearz to do but I feel like this one is going to be hard for Aww So Cute to prove.
 
Chinese business is funny stuff. The one with the most money get things. Others back of line
 
At this point I'm not even surprised, it seems like all the big diaper companies are just in a massive, human centipede of suing each other and trademarking so that they can sue each other.
