Thread: Update #1

    Default Update #1

One of the attorneys I spoke with about my kidnapping finally called me back. After reviewing my medical records from the hospital, she was mortified and suggested that this was well beyond a "medical malpractice" case and that I needed to contact a Civil Rights attorney. She gave me a few phone numbers to get me started. Evidently, this isn't the first time she has heard of "excessive force" being used at that particular hospital, but she was particularly perturbed by my case and by the gaps in my medical records surrounding the incident. There are medical tests and anecdotal nurse and doctor reports every few hours, mostly describing me as "pleasant and engaging" (I try), but there is no record of the kidnapping incident itself and the medical records just sort of stop for about 16 hours before suddenly resuming again.

She did indicate that it will be difficult to pursue direct legal action since I didn't actually die so there are no damages to prove (interestingly, it occurs to me there'd be nothing to prove if I was dead either...). But she understood the emotional impact of such an event. I will not even set foot in an ER without an escort who can act as my bodyguard, because else there is nothing stopping a gang of thugs from randomly storming the room and carrying me off to who-knows-where. Been there, done that.

I guess we'll see where things go from here.

Disturbing. Weighing the odds of going through it again in court with what sounds like marginal chance of success vs. putting it behind you and moving on.

I would guess that your chances of getting some sort of civil settlement would be greater than getting a criminal conviction, if that floats your boat.

Bear in mind that I'm not and never have been a lawyer nor have I played one on TV.

I'm not sure what would float my boat exactly at this point, other than having a hired bodyguard who's paid for so I can safely access medical services. Oh, and someone to punch when the nightmares about being kidnapped strike, heh.

I'm trying to just let it go, but it hasn't been easy. And I'm not entirely sure it's the right thing to do.
